What we do

Personal Injury Claims

Where an injury has been caused by the negligence of another party, it may be appropriate to investigate whether there are grounds to pursue a claim. Many clients come to us following an incident that has disrupted their routine, affected their ability to work, or resulted in ongoing symptoms that were not expected.

Understanding your concerns

Personal injury claims often arise where there are questions about whether reasonable steps were taken to prevent harm. Concerns may include:

road traffic accidents caused by another driver

unsafe working conditions leading to injury

accidents in public places where hazards were not addressed

failures by those responsible for safety to take appropriate precautions

In each case, the issue is whether a duty of care was owed and whether that duty was breached.

Types of cases we handle

We act in a range of serious personal injury claims, including:

road traffic accidents, including claims involving uninsured or untraced drivers through the Motor Insurers' Bureau (MIB)

employer's liability claims

public liability claims, including slips, trips and falls

accidents abroad arising from package holidays

Each case is assessed on its own facts and requires careful consideration of both liability and the extent of the injury.

Claims involving uninsured or untraced drivers (MIB)

In some cases, the party responsible for an accident may be uninsured or cannot be identified. In these circumstances, a claim may still be pursued through the Motor Insurers' Bureau (MIB). These claims are subject to specific procedures and requirements, and it is important that they are handled correctly from the outset.

A practical and measured approach

Our approach is the same across all cases: careful assessment, clear advice, and a focus on achieving the right outcome.

We bring the same depth of care and experience to every personal injury matter we handle. Our focus is on achieving quality outcomes and ensuring that clients receive clear, considered advice at every stage; whatever the nature or complexity of the case.

Assessing the claim

Establishing liability

In personal injury claims, it is necessary to establish that:

a duty of care was owed

that duty was breached

the breach caused or contributed to the injury

This may involve considering:

how the accident occurred

whether appropriate safety measures were in place

whether the risks were foreseeable

whether reasonable steps were taken to prevent harm

Evidence may include witness accounts, accident reports, photographs and other supporting material.

Causation and impact

Even where fault can be established, it must also be shown that the injury resulted from the incident. This may involve:

medical evidence confirming the nature and extent of the injury

assessment of how the injury has affected day-to-day life

consideration of whether symptoms are ongoing or long-term

In more serious cases, this may include the impact on work, independence and future plans.

Helping you get the answers and compensation you deserve

Compensation and outcomes

Where a personal injury claim is successful, compensation may be recoverable for:

pain, suffering and loss of amenity

financial losses, including loss of earnings

medical treatment and rehabilitation

care and support needs

future losses, where applicable

The level of compensation will depend on the individual circumstances of the case. Our role is to ensure that any claim reflects the full impact of the injury and its consequences.

How we handle our cases

A practical and measured approach

Personal injury claims require careful assessment of both liability and the impact of the injury. Our approach is to provide clear, straightforward advice based on the available evidence.

Not every case will proceed. Where the evidence does not support a claim, you will be advised of that at an early stage.

Our focus is on achieving quality outcomes and ensuring that clients receive clear, considered advice at every stage; whatever the nature or complexity of the case.

Time limits for bringing a claim

In most cases, a claim must be brought within three years. However, this is not always straightforward.

In medical negligence cases, the time limit may run from:

the date of the incident; or

the date on which you first became aware that something may have gone wrong

Different rules apply in cases involving:

children

individuals who lack capacity

If there is any uncertainty about your time limit, it is important to seek advice at an early stage. Failing to settle or issue proceedings within the relevant limitation period may result in your claim becoming statute barred, meaning you lose the right to pursue it entirely.

It is also important to be aware that we may not always be able to accept instructions where insufficient time remains within the limitation period to investigate and prepare a claim properly.
